1. Services and Client Agreements

The Company provides professional web development, hosting solutions, domain registration, and online/offline marketing services.

• Specific Contracts: While these Terms apply to general website use, specific projects, service level agreements (SLAs), and ongoing developments will be governed by separate, signed legal contracts or Quotations between the Company and the Client.
• Service Modifications: We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice, though we will make reasonable efforts to notify contractual clients in advance.

2. Intellectual Property Rights

Unless otherwise indicated, the Site, its source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) are owned or licensed by us and are protected by copyright and trademark laws.

• For Clients: Upon full payment of all fees due to the Company for web development or software services, the specific intellectual property rights of the delivered final product will transfer to the Client as specified in the individual Client contract.
• Restrictions: You may not copy, reproduce, aggregate, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, license, or otherwise exploit any Content from our Site for commercial purposes without our express prior written permission.

3. User Accounts and Security

To access certain Services or client portals, you may be required to register an account.

• You agree to provide accurate, current, and complete information during the registration process.
• You are entirely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.
• You must notify us immediately at [email protected] if you suspect any unauthorized use of your account or breach of security. We cannot and will not be liable for any loss or damage arising from your failure to protect your login credentials.

4. Hosting and Domain Management

For clients utilizing our web hosting and domain services:

• Acceptable Use: You agree not to use our hosting infrastructure for any illegal activities, including but not limited to hosting malicious software (malware), phishing sites, spamming, or violating intellectual property rights.
• Suspension: We reserve the right to suspend any website or hosting account immediately if it poses a security risk to our servers, exceeds resource limits drastically, or violates local/international laws.
• Domain Renewals: Domain renewals are the ultimate responsibility of the client. The Company will send renewal notifications, but we are not liable for lost domains due to late payments or failure to respond to renewal notices.

5. Prohibited Activities

As a user of the Site, you agree not to:

• Systematically retrieve data or other content from the Site to create or compile a collection, compilation, database, or directory without written permission from us.
• Circumvent, disable, or otherwise interfere with security-related features of the Site.
• Engage in unauthorized framing of or linking to the Site.
• Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
• Use any automated system, such as scripts, robots, or scrapers, to access the Site for data mining purposes.

6. Limitation of Liability

To the fullest extent permitted by law, Myanmars Net Software Co., Ltd., its directors, employees, or agents shall not be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site or Services, even if we have been advised of the possibility of such damages.

We provide our general website and standard hosting options on an “as-is” and “as-available” basis unless otherwise explicitly protected under a dedicated premium Service Level Agreement (SLA).

These Terms shall remain in full force and effect while you use the Site or Services.

Without limiting any other provision of these Terms, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Site and Services to any person for any reason, including without limitation for breach of any representation, warranty, or covenant contained in these Terms or of any applicable law or regulation.

8. Governing Law

These Terms and your use of the Site and Services are governed by and construed in accordance with the laws of [Myanmar], without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in that jurisdiction.
